The petitioner seeks bail in Bhargama P.S. Case No. 200/2014, registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

The petitioner is not named in the FIR and nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of Md. Jamil and Shashi Kumar Yadav from whose possession looted articles are said to have been recovered.

It is submitted that co-accused Md. Jamil has already been enlarged on bail vide order passed in Cr. Misc. No. 15566 of 2015. The petitioner is in jail since 23.03.2015 but he has not been put on Test Identification Parade.

Considering the facts aforesaid, the petitioner above named

Patna High Court Cr.Misc. No.31104 of 2015 (2) dt.17-08-2015 2/2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S.
