Petitioner is languishing in custody since 18.09.2014 in a case registered for the offences punishable under Sections 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that the petitioner caused firearm injury with country made pistol on the arm and abdomen of the informant.
It is submitted by the learned counsel for the petitioner that injury report reflects only one injury on the left arm though the same has been treated to be grievous, whereas other injury is found on the lower part of the chest caused by hard object, simple in nature, hence the accusation is not corroborated with the medical opinion.
Patna High Court Cr.Misc. No.12508 of 2015 (3) dt.29-06-2015 Considering the fact that the investigation has already been concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Mashrakh P.S. Case No. 169 of 2014.
Since the petitioner is accused in two other cases, the learned court below will be at liberty to cancel the bail bonds of the petitioner if he defaults for two consecutive occasions.
