The petitioner seeks regular bail in connection with Kathaiya P.S. Case No. 140 of 2021 instituted for the offences punishable under Sections 399, 402, 120(b) of the Indian Penal Code and 25(1-b)a, 26 and 35 of Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 06.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is recovery of one loaded country made pistol with one cartridge from the possession of the petitioner.

No.5603 of 2022(2) dt.13-06-2022 2/2 Learned counsel for the petitioner submits that the petitioner is innocent and he denies the whole allegations levelled against him in the F.I.R including recovery of incriminating articles from the possession of the petitioner. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 06.10.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 4th (West), Muzaffarpur in connection with Kathaiya P.S. Case No. 140 of 2021.
