JUSTICE SANDEEP KUMAR ORAL ORDER 16-04-2024 Heard the learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner seeks regular bail in a case registered for the offence under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, deceased was called by the accused persons including the petitioner and thereafter he was surrounded by the accused persons and one Babloo Sahani fired at him killing the deceased on the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and there is no overt act alleged against the petitioner and he has been named only because he stays in that area. Petitioner is in jail since 23.11.2023.

5. Learned counsel for the informant Ms. Ananya Shivani has vehemently opposed the prayer for bail and has submitted that petitioner is a member of a gang of criminals and after surrounding the deceased, they have killed the deceased.

6. Learned A.P.P. has also opposed the prayer for bail.

7. I have considered the submissions of the parties. It appears that a group of criminals under a plan called the deceased and killed him. During investigation, petitioner's presence has been found in the CCTV Footage.

8. Considering the involvement of the petitioner in the murder, I am not inclined to grant bail to the petitioner.

9. Accordingly, this application for regular bail is dismissed. The court below is directed to expedite the trial of the petitioner.

10. If the trial is delayed, the petitioner may renew his prayer for bail.
