JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-07-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 30a of the Indian Penal Code.

Prosecution case is that 162 liters wine was recovered from a hut and petitioner was identified by the local people as one who fled away from the place of recovery on seeing police party.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.

Patna High Court CR. MISC. No.5588 of 2022(2) dt.01-07-2022 2/2 Considering the nature of allegation, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in Barh Police Station Case No. 458 of 2021/ Special Case No. 7203 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
