The petitioner is apprehending his arrest in connection with Rajpur P.S.Case no.286 of 2017 registered on 2.11.2017 , registered for offences punishable under Sections 363, 364, 302, 34 of the Indian Penal Code.
Allegation as per FIR is that the deceased was called by the co-accused Raju Chauhan and others and later on he came to know that the deceased has received injury due to electrical shock and he was taken to his native.
Submission of the learned counsel for the petitioner is that there is delay of one month in lodging the FIR and as a matter of fact the deceased was lying on the electric poll, in the meantime, the current came and he received electric current injury and the another co-accused Raju Chauhan has been
Patna High Court CR. MISC. No.2772 of 2019(4) dt.13-03-2019 2/2 granted bail vide order dated 8.2.2018 passed in Cr. Misc. No.77849 of 2018.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Buxar in connection with Rajpur P.S.Case No.286 of 2017 arising out of Complaint Case No.585(C) of 2017, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
With the aforesaid observation, this application is allowed.
