Mr. Nishi Nath Ojha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE MADHURESH PRASAD ORAL ORDER 22-06-2023 1.

Heard learned counsel for the petitioner and learned counsel for the respondent-Bank.

2.

The petitioner's appeal against the order of punishment dated 31.07.2018 was filed before the Respondent No. 1 on 23.03.2022. It is the limited grievance of the petitioner that the appeal has not been considered and decided by the appellate authority, till date.

Patna High Court CWJC No.1629 of 2023(2) dt.22-06-2023 2/2 3.

Learned counsel for the respondent-Bank does not dispute that the appeal is required to be disposed of on its own merits in accordance with law.

4.

The writ application, therefore, need not be kept pending as the same is not raising any issues which are required to be adjudicated, since the petitioner's punishment is pending consideration before the appellate authority (Respondent No. 1).

5.

With direction to the Respondent No. 1 to dispose of the appeal within three months from the date of receipt/production of a copy of this order, writ application is allowed.
