03-03-2020 Heard learned counsel for the parties.

The petitioners apprehend their arrest in Bahadurpur P.S. Case No. 577 of 2019 registered for the offence under Sections 341, 323, 324, 354, 379, 504, 506/34 of the Indian Penal Code.

As per F.I.R., petitioners are said to have abused the mother and wife of the informant. Petitioner no. 1 is said to have assaulted the mother of informant with a glass and allegation against petitioner no. 2 is that he alongwith petitioner no. 1 committed marpit and took away Rs. 1200/- from the house of informant.

It is submitted on behalf of petitioners that

Patna High Court CR. MISC. No.4333 of 2020(2) dt.03-03-2020 2/2 petitioners have falsely been implicated in this case due to enmity. There is general and omnibus allegation. It is further submitted that there is case and counter case between the parties. No case under Section 354 of the Indian Penal Code is made out. Petitioners have no criminal antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bailbonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Darbhanga in connection with Bahadurpur P.S. Case No. 577 of 2019, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
