ANJANA MISHRA ORAL ORDER 20-08-2015 Heard learned counsel for the petitioner and the learned counsel for the State.

The petitioner is apprehending his arrest in connection with Ahiyapur P.S. Case No.177 of 2015 for allegedly having committed the offence under Sections 341, 323, 364, 366A, 379, 504 and 120B of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Muzaffarpur.

Learned counsel for the petitioner submits that the allegation is squarely against one Md. Salam and not against this petitioner.

However, it appears that the court below after considering the case diary has found that the victim in her

Patna High Court Cr.Misc. No.32996 of 2015 (2) dt.20-08-2015 2/2 statement under Section 164 Cr.P.C. has specifically stated that Md. Gulam has also allured her and taken her to Ludhiana where he had actively participated in keeping her in a locked room.

Considering the aforementioned facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected. (Anjana Mishra, J) PNM U T
