====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 323, 341, 307, 379/34 of the Indian Penal Code.

Prosecution case as per the written report of Buletan Kumar submitted before the S.H.O., Asthawan P.S. is to the effect that in pursuance to the decision of Panchayat representatives, when the informant went to collect money from the petitioners, they assaulted the informant, resorted to fire and snatched a gold chain from the neck of the informant. It is submitted by the learned counsel for the petitioners that the injuries have been found simple. General and

Patna High Court CR. MISC. No.4591 of 2020(2) dt.29-02-2020 2/2 omnibus accusation has been made against the petitioners. It is further submitted that version of the alleged occurrence also counter case Asthawan P.S. Case No. 122 of 2019 has also been registered, by the petitioners' side against informant's side. A statement has been made in paragraph 3 of the petition that the petitioners are having no criminal antecedent. Considering the fact that injuries have been found simple in nature and there being a counter version of the occurrence, coupled with the fact that the petitioners are having no criminal antecedent, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of Rs.

10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Nalanda at Biharsharif in connection with Asthawan P.S. Case No. 122 of 2019, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
