Petitioners apprehend their arrest in connection with Kursela PS Case No. 190 / 2019 dated 17-10-2019 registered under Section 341, 323, 307 / 34 of the IPC.

As per the FIR the petitioners assaulted the informant by means of iron rod causing head injury.

Learned counsel for the petitioners submits that informant is the son of the petitioner no. 1 and brother of the petitioner no. 2 and due to some family dispute the present FIR has been lodged. He next submits that injury caused to the informant is simple in nature as would be evident from the impugned order itself.

No.6509 of 2023(2) dt.18-05-2023 2/2 Regard being had to the submissions made by the parties, taking into consideration the fact that both the parties are close relatives, the informant is the son of the petitioner no. 1 and injury caused to the informant is simple in nature, I am inclined to grant anticipatory bail to the petitioners. Let the petitioners, above named, be released on anticipatory bail in the event of their arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Katihar in connection with Kursela PS Case No. 190 of 2019 subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
