JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 11-02-2019 This writ petition has been filed by the petitioner for directing the respondents to release Hero Passion Pro Motorcycle bearing Registration No. BR-32U 5367, which has been seized in connection with Khajauli P.S. Case no. 114 of 2018 registered under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

After some arguments, learned counsel for the petitioner submitted that the writ petition may be disposed of with liberty to the petitioner to pray for release of the vehicle in question before the court below itself under Section 451 of

Patna High Court Cr. WJC No.349 of 2019(2) dt.11-02-2019 2/2 the Code of Criminal Procedure.
