The petitioner seeks regular bail in connection with Supaul P.S. Case No. 713 of 2021, instituted for the offence under Sections 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 05.11.2021 is a person with clean antecedent. Charge-sheet has been submitted in the case and the informant alleged that on 03.10.2021 at about 08:15 P.M four unknown criminals entered his office and assaulted the informant and his colleague and looted Rs. 11,93,268/- along with 29 mobiles and fled away. Learned counsel submits that the F.I.R. was against unknown, the name of the petitioner transpired on the confessional statement of co-accused Rohit Kumar and
Patna High Court CR. MISC. No.5979 of 2022(2) dt.09-06-2022 2/2 Vikash Kumar. The said looted mobiles have been recovered from co-accused Rohit and Vikash Kumar and nothing has been recovered from the possession of the petitioner. Vikash Kumar has been granted bail by this Hon'ble Court in Cr. Misc. No. 1911 of 2022 on 19.05.2022.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail application of the petitioner. Considering the facts and circumstances of the case, the petitioner is in custody since 05.11.2021, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Supaul P.S.
