====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Section 419, 420, 170, 171/34 of the Indian Penal Code.

The prosecution case, in nutshell, is that petitioner along with other co-accused persons have opened the forged office in the name of SPCA ALL INDIA, Animal Taskari and Cruelty Roktham, Sanrakshan and Suraksha in connivance of each other.

It is submitted by learned counsel for the petitioner that the petitioner is innocent and he has falsely been implicated in the present case. It is further submitted that an N.G.O. has been registered under Registration Act vide Registration Act on 22.11.2018 in the name of Society For Prevention of Cruelty to

Patna High Court CR. MISC. No.8173 of 2023(2) dt.12-05-2023 2/2 Animals (SPCA). It is further submitted that after due process, an office of the said SPCA has been opened in the Khagaria district and the same has been informed to D.M. and S.P. of concerned district. Moreover, similarly situated co-accused person has already been granted bail by co-ordinate Bench of this Court vide order dated 13.04.2023 passed in Cr. Misc. No. 8342 of 2023. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-III, Khagaria in connection with Khagaria Chitragupt Nagar P. S. Case No. 980 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
