JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Bhagwanpur P.S. Case No. 172 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act 2016.
Allegation is of recovery of 258 liters liquor from a Centro vehicle and names of two persons transpired, but they succeeded in fleeing away, later on one of the co-accused has been arrested and on his confessional the name of the petitioner transpired.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and nothing has been recovered from his conscious possession or from his house and he has no criminal antecedent. Further submission is that other co-accused person has been granted
Patna High Court CR. MISC. No.13029 of 2019(3) dt.30-04-2019 2/2 privilege of anticipatory bail by a Coordinate Bench of this Court vide order dated 19.02.2019 passed in Cr. Misc. No. 9725 of 2019.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II- Begusarai cum Special Judge, in connection with Bhagwanpur P.S. Case No. 172 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
