Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 307, 354, 379, 504 and 506 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that the accused person, including the petitioner came and started abusing her and when she objected, the petitioner along with other accused persons assaulted her with fist and slaps and even tore her blouse, and when her husband came to save her, he was assaulted by Shiv Nandan Paswan by sword causing injury on head, further, the family members of the

Patna High Court CR. MISC. No.11222 of 2024(2) dt.07-03-2024 2/3 informant were also assaulted and Shashi Nandan Paswan threatened with pistol that he will not allow the informant and the family members to construct their house on the land. 4.

Learned counsel submits that from perusal of the allegation as alleged in the FIR, it would manifest that on account of dispute relating to land, the present occurrence is alleged to have taken place and as far as this petitioner is concerned, the allegation against him is of assaulting the informant with fist and slaps and tearing her blouse, but then the allegation of assault and tearing of blouse is ornamental in nature. It is next submitted that several accused persons had come and allegation of assault is against all the accused persons, though specific allegation of assault of assaulting her husband is against Shiv Nandan Paswan. It is also submitted that the injury suffered by the informant is simple in nature. 5.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner and fact that petitioner is a person with clean antecedent, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on

No.11222 of 2024(2) dt.07-03-2024 3/3 furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Parwalpur P.S. Case No. 192 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
