The instant application has been filed for extension of

Patna High Court MJC No.5181 of 2018(3) dt.09-07-2020 2/2 time to prefer appeal before the State Appellate Authority. Counsel for the petitioner submits that the petitioner was granted one month time vide order dated 19.02.2018 passed in C.W.J.C. No. 9387 of 2016 to file appeal, but due to compelling circumstance, the petitioner could not prefer the appeal before the State Appellate Authority within the time granted by this Court.

Considering the aforesaid, order dated 19.02.2018 passed in C.W.J.C. No. 9387 of 2016 is modified to the extent that the petitioner may now prefer appeal before the State Appellate Authority within a period of one month from today and on filing of such appeal along with a copy of this order, the State Appellate Authority will appropriately decide the appeal on its own merit.
