The petitioner seeks bail in anticipation of his arrest in connection with Dumra P.S. Case No. 276 of 2020 instituted for the offences under Sections 406/420/120(B) of the Indian Penal Code and Section 25(I-b)a, 35/27 of the Arms Act.

It appears from the prosecution case that two employees of the informant who were coming back after collecting the sale proceeds were followed by miscreants. One of them was apprehended, who disclosed that it was one of the employees of the informant who was involved in

Patna High Court CR. MISC. No.16199 of 2021(3) dt.01-04-2022 2/2 this case. When that employee was interrogated, he is said to have named the petitioner as one of his accomplices. The learned counsel for the petitioner submits that the accusation against him is only based on confession of an arrested accused person. It has further been submitted that nothing incriminating has been recovered from the possession of the petitioner and he has clean antecedents. Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Dumra P.S. Case No. 276 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashutosh Kumar, J) sunilkumar/- U T
