The petitioner seeks regular bail in connection with Kotwali (Barari) Police Station Case No. 1175 of 2022, dated 10.12.2022, registered for the offences punishable under Sections 370/370-A/120-B/34 of the Indian Penal Code, Sections 3/4/5/6/7 of the Immoral Traffic Prevention Act and Sections 18 (c)/27 (b) (ii)/28/28(a)/36 (ac) of the Drugs and Cosmetics Act.

The prosecution case, as per the First Information Report, is that the police got the information that some suspicious activities are going on in the house of co-accused Vicky Yadav, conducted a raid in the house of Vicky Yadav and

It has been alleged that the two other ladies disclosed that the petitioner brought them in the trade of immoral act. The police recovered 130 bottles of cough syrup of 100 ml. each from the house, in question.

Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case without any basis. He next submits that the petitioner has been made accused merely on the basis of the statements made by the other two ladies without any material on record to show that at the time of raid, they were indulged in the immoral activities. He further submits that the petitioner is in custody since 11.12.2022, having no criminal antecedent, and charge sheet has already been submitted against her and there is no likelihood that the petitioner will abscond and/or tamper with the evidence. Regards being had to the submissions made on behalf of the parties and taking into consideration the materials on record and the fact that charge sheet has already been submitted and the petitioner is in custody since 11.12.2022, having no criminal antecedent, I am inclined to grant regular bail to the petitioner.

This application is, accordingly, allowed.
