The petitioner seeks regular bail in Belsand P.S. Case No. 140 of 2013 registered for the offence under Sections 304B/34 of the Indian Penal Code.
The informant is the brother of the deceased and he made allegation that the petitioner and other in-laws of the deceased killed his sister.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.31247 of 2014 (3) dt.12-01-2015 2/2 petitioner is the husband. During the course of investigation at paragraph -54, the father of the deceased stated that his daughter was living happily in her Sasural. The son of the deceased also did not complain of any ill-treatment at the hands of the petitioner. From perusal of the post mortem report, it appears that stomach contains fuel smelling brownish liquid which shows that the victim was poisoned to death but a different story was given. Somebody says that deceased died due to snake biting. Considering the facts that the petitioner is the husband and wife died of poisoning, I am not inclined to grant bail to the petitioner. Accordingly, the same is rejected. However, the Trial Court is directed to expedite and conclude the trial within a period of nine months from the date of the receipt of the order. If the trial is not concluded within the aforesaid period, the petitioner may renew his prayer for bail. (Prabhat Kumar Jha, J) Jagdish/- U T
