2. The petitioner seeks regular bail in connection with Itarhi P.S. Case No. 254 of 2023 registered for the offence under Sections 379 and 411 of I.P.C.

3. As per the prosecution case, It is a case of theft of Tractor and other materials.

4. Learned counsel for the petitioner submits that the petitioner is innocent, committed no offence and has falsely been implicated in the present case. The petitioner has no criminal antecedent as stated in paragraph 3 of the petition. He further submits that the petitioner is in custody since 16.11.2023.

5. However, learned APP for the State vehemently opposed the prayer for regular bail.

6. Having heard learned counsel for the parties, perused the FIR, impugned order dated 05.01.2024. It appears that stolen property is tractor and tailor which was already recovered. The offence against the petitioner is under Section 379 and 411 of Indian Penal Code. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Buxar in connection with Itarhi P.S. Case No. 254 of 2023.
