Petitioner is languishing in custody since 22.05.2015 in a case registered for the offences punishable under Sections 304/34 of the Indian Penal Code. The prosecution case is that the wife of the informant was admitted to Deep Clinic at the instance of the petitioner being the staff of the said clinic and Dr. Rajendra Prasad. Subsequently, the wife of the informant died after the operation being performed by Dr. Rajeshwar Prasad. Learned counsel for the petitioner submits that the petitioner has been maliciously roped in the present case and he is not the staff of Deep Clinic. Moreover the thrust of accusation is against Dr. Rajeshwar Prasad and even assuming the accusation at best a case under Section
Patna High Court Cr.Misc. No.30452 of 2015 (2) dt.21-07-2015 304A IPC is made out against Dr. Rajendra Prasad who performed the operation. Statement has been made in para3 of the petition that petitioner has no criminal antecedent. Moreover, investigation has already concluded. Considering the aforementioned facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Nawada (Town) P.S. Case No. 330 of 2015.
