====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 15-03-2023 Heard Mr. Shantam Shivam, learned counsel appearing on behalf of the petitioner and Mr. Ashok Kumar Singh, learned APP appearing on behalf of the State.

2. Petitioner seeks bail in connection with Charpokhari P.S. Case No. 190 of 2019 registered under Sections 304(B)/34 of the Indian Penal Code.

3. Petitioner had earlier moved before this court for grant of regular bail by filing Cr. Misc. No. 42459 of 2021 which was rejected by this Court vide order dated 09.03.2022 with liberty to the petitioner to renew his prayer for bail, if no substantial progress takes place in the trial.

4. A report was called for from the court below with respect to the stage of the trial vide order dated 15.02.2023 and in compliance of the same, learned Additional Sessions Judge-

Patna High Court CR. MISC. No.8034 of 2023(3) dt.15-03-2023 2/2 XIII, Bhojpur at Ara vide Letter No. 32 dated 21.02.2023 has informed that the case is being taken up on priority basis and and the next date was fixed on 01.03.2023 for examination of remaining prosecution witnesses.

5. Considering the aforesaid report, I am not inclined to enlarge the petitioner on bail at this stage. Accordingly, the bail application stands rejected.

6. However, the Superintendent of Police, Bhojpur at Ara is directed to produce all the official as well as prosecution witnesses on the next date fixed by the trial court. The trial court is expected to conclude the trial well within a period of six months without fail.
