The petitioner seeks bail in a case under Section 302 and other Sections of the I.P.C. and Section 27 of the Arms Act. The petitioner alongwith other accused persons is alleged to have made indiscriminate firing on the abdomen of the deceased Md. Wahid.
Prayer for bail of the petitioner was earlier rejected vide order dated 26.05.2014 passed in Cr. Misc. No. 13098 of 2014. It is submitted that no specific allegation was made against the petitioner but from perusal of the post mortem report of the deceased it appears that the deceased got two injuries.
Patna High Court Cr.Misc. No.7175 of 2015 (4) dt.30-06-2015 2 / 2 Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected in Narpatganj P.S. Case No. 348 of 2013, G.R. No. 2934 of 2013, S.T. No. 371 of 2014, pending in the court of the learned Adhoc A.D.J. IVth, Araria.
The Trial Court is directed to expedite the trial and conclude the same within nine months from the date of receipt of this order. If the trial is not concluded within nine months, the petitioner may renew prayer for bail firstly in the learned court below.
