2. In the present case, the petitioner seeks bail in connection with Supaul P.S. Case No. 68 of 2023 registered for the alleged offences under Section 392 of the Indian Penal Code.

3. As per the prosecution case, while the informant was on way on his motorcycle, four persons riding two motorcycles overtook the motorcycle of the informant and stopped him. Out of them, two miscreants were carrying firearms. They demanded key of the motorcycle from the informant and when the informant refused they assaulted him and started the motorcycle with their own keys and took away his motorcycle. The name

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. As the petitioner is having criminal antecedent he has been made accused in this case. The confessional statement of the petitioner is of no value in the eye of law. Nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner is having antecedent of six cases. In one case, he has been acquitted and in five cases he is on bail. The petitioner is in custody since 11.02.2023 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Supaul in connection with Supaul P.S. Case No. 68 of 2023, subject to the following

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below.
