Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 and 120(b) IPC and Section 27 Arms Act.

Submission is that there is no eye witness of the actual occurrence. Co-accused Karan Saxena has already been allowed bail by a Coordinate Bench of this Court vide order at Annexure-2. The impugned order does not reveal that any direct material was there against the petitioner. Investigation of the case is already complete.

Hence, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.16042 of 2021(2) dt.19-07-2021 2/2 bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.168 of 2020 arising out of Rahui Police Station Case No.72 of 2020 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
