The petitioners seek bail in Imamganj P.S. Case No. 59 of 2021, registered for the offence punishable under Sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, on 29.03.2021 at about 4.00 PM brother of informant assaulted his wife and went outside his house, but he did not return. On 31.03.2021 at about 7.00 AM, informant received information on mobile that dead body of his brother was lying in Kochiya Aahar, then informant along with his cousin reached there and found the dead body of

Patna High Court CR. MISC. No.6175 of 2022(3) dt.17-05-2022 2/2 his brother having several injuries lying in Kochiya Aahar. Informant suspects that all the FIR named accused persons including petitioners killed the brother of informant and threw dead body in Kochiya Aahar.

It is submitted on behalf of the petitioners that petitioner no. 1 is father-in-law, petitioner no. 2 and 3 are brother-in-law and petitioner no. 4 is wife of the deceased and they have been made accused in this case only on suspicion. Informant is not eye-witness of the occurrence. There is no tangible and cogent material against petitioners and they are in custody since 11.04.2021. Investigation is complete. Considering the facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Sherghati, Gaya in connection with Imamganj P.S.
