The petitioners seek bail in Bihta P.S. Case No. 186 of 2014 registered under sections 20, 21, 22 and 27 of the N.D.P.S. Act. The petitioners were apprehended and from their possession 20 gms and 30 gms smacks heroin were recovered. Learned counsel for the petitioners submits that up to 250 gms of heroin comes in the category less than commercial quantity. The petitioners are in jail for ten months. Having considered the fact that more than small quantity and less than commercial quantity was recovered from the possession of the petitioners, the above named petitioners are directed to be enlarged on bail on
Patna High Court Cr.Misc. No.34878 of 2014 (3) dt.19-01-2015 2/2 furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Additional Sessions Judge-VII-cum- Special Judge, N.D.P.S.Act, Patna in Bihta P.S. Case No. 186 of 2014 corresponding to Special Case No. 26 of 2014.
