29-02-2020 Heard learned counsel for the parties.

The petitioners apprehend their arrest in G.R.No. 1330 of 2018/Minapur P.S. Case No. 122 of 2018 registered for the offence under Sections 302/201/34 of the Indian Penal Code. As per FIR, the daughter of the complainant/ informant was married to one Pankaj Kumar in the year 2012, but due to non-fulfillment of further demand of Rupees one lac, as dowry, the daughter of the informant was subjected to cruelty by her in-laws members and ultimately, she was done to death. It is further alleged that accused persons hurriedly committed funeral without giving information to complainant/informant. It is submitted on behalf of petitioners that both petitioners are lady and have committed no offence. Petitioner no. 1 is Gotni of deceased, whereas petitioner no. 2 is unmarried

Patna High Court CR. MISC. No.3930 of 2020(2) dt.29-02-2020 2/2 Nanad of deceased and there is general & omnibus allegation against them. There is no eye-witness to the alleged occurrence. It is further submitted that petitioners are living separately and have no concern with the affairs of the deceased. In view of aforesaid facts and circumstances, in the event of their arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 122 of 2018 (G.R. No. 1330 of 2018) on the following conditions:

"(1) Petitioners shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present, as directed by the Court and on their absence on two consecutive dates without sufficient reason, their bail-bonds shall be cancelled by the Court below.

(2) If the petitioners tamper with the evidence or the witnesses, in that case, the prosecution will be at liberty to move for cancellation of bail."
