JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are not named in the first information report and according to the prosecution case itself, one co-accused Pappu shot fire on the deceased.
The impugned order goes to show that the name of petitioners came in confessional statement of co-accused Dhananjay, who stated that petitioners had also participated in conspiracy and except the aforesaid material as well as criminal antecedent , there appears to be nothing against the petitioners. Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.21038 of 2016 (2) dt.20-05-2016 2/2 cases, mentioned at para-3 of the petition, were lodged against the petitioners due to dispute with their agnates. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S.Case No. 359 of 2015.
