2. Counter affidavit of Superintendent of Police, West Champaran is taken on record.

This application has been filed for directing the respondents to ensure the recovery of the elder brother of the petitioner, who is traceless since 03.08.2015 and further for taking proper legal action against the respondents for not complying the order dated 04.10.2016 and also also directing the respondents to immediately take proper legal action against accused persons of Shikarpur P.S. Case No. 509/2015 for the

Patna High Court CR. WJC No.1158 of 2017(5) dt.18-07-2023 2/2 offence under Sections 364/302/201, 120B/34 of the Indian Penal Code.

4. The Superintendent of Police, West Champaran has appeared personally before this Court and he has apprised this Court for the steps taken for tracing the missing person. He further submits that the missing person should be traced. He also submits that action has been taken against the erring Investigating Officers, who have not taken any steps for tracing the missing person.
