Mr.Raj Kishore Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-01-2019 Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Rajnagar P.S. Case No. 247 of 2018, registered for the offence punishable under Sections 457, 380, 34 and 411 of the Indian Penal Code.

The allegation in the present case is that when the police was on patrolling duty, they saw two accused persons fleeing away and when they were caught, some mobile phones were recovered from them, which are stated to be stolen ones.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in fact, no recovery has been made from the conscious

Patna High Court Cr.Misc. No.2464 of 2019(2) dt.18-01-2019 2/2 possession of the petitioner. It is further submitted that the petitioner is having a clean antecedent and he is languishing in custody since 06.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Madhubani in connection with Rajnagar P.S. Case No. 247 of 2018.
