Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 379/34 of the Indian Penal Code and Section 27 of the Arms Act.
As per prosecution case, petitioner is alleged to have fired with country made pistol and snatched gold chain from the neck of the informant's son.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He next submits that though there is allegation of firing but no one sustained any fire arms injury. No incriminating material has been recovered from the possession
Patna High Court CR. MISC. No.5713 of 2023(2) dt.11-05-2023 2/2 of the petitioner. Present case is counter blast of Dinara P. S. Case No. 249 of 2022. Petitioner has got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-02, Bikramganj, Rohtas in connection with Dinara P. S. Case No. 244 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
