21.08.2015 The Petitioner who is the husband seeks transfer of Complaint Case filed by Opposite Party No. 2 from the Court at Vaishali at Hajipur to the Court of competent jurisdiction at Muzaffarpur on the ground that the parties are common.
On the last occasion, notices had been issued to the Opposite Party No. 2 but none appears on her behalf. Considering the address of the Opposite Party No. 2 being at Muzaffarpur, let Complaint Case No. 3346 of 2008 pending before the Sub-divisional Judicial Magaistrate, Vaishali at Hajipur be transferred to the Court of Sub-divisional Judicial Magistrate, (West) Muzaffarpur within a period of three weeks from the date
Patna High Court Cr.Misc. No.31649 of 2014 (3) dt.21-08-2015 of receipt of this order. After being transferred of the case at Muzaffarpur the Court at Muzaffarpur is directed to amalgamate the said case with Kanti P.S. Case No. 271 of 2008 within six weeks since both the cases arise out of the same cause of action after noticing to the Counsel appearing on behalf of the Opposite Party No. 2. The Application stands disposed off with the aforesaid observations.
