JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offences punishable under sections 420, 468, 472 and 120B of the Indian Penal Code.

One Admit Card of J.E. Examination of the petitioner was recovered from Flat No.404 of Ramraj Apartment during raid conducted by the police.

Submission is of false implication and that besides the aforesaid material, there is nothing against the petitioner, he is not named in the first information report, but later on, on the basis

No.22593 of 2016 (2) dt.25-05-2016 2/3 of the alleged recovery, the petitioner has been made accused in this case resulting he is suffering in custody since 7.4.2016, similarly situated other co-accused, namely, Raj Kumar, Sanjeev Kumar and several others have been allowed bail by another Coordinate Bench of this Court and, as such, the petitioner also deserves sympathetic consideration.

The learned A.P.P. fairly submits that some of the coaccused have been allowed bail, but from the impugned order, it reveals that the petitioner, after manipulation, enhanced marks 99 by committing fraud in the scan copy of OMR sheet. In the facts and circumstances stated above, considering that other co-accused similarly situated have been allowed bail and, as such, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna in connection with Economic Offence P.S. Case No.23 of 2012, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two

Patna High Court Cr.Misc. No.22593 of 2016 (2) dt.25-05-2016 3/3 consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
