The present petition has been filed for:- "directions commanding the respondents to either get the land, details are given in Annexure-1, of the petitioner free or to pay the compensation under the Land Acquisition Act at the rate of present market value and pay the compensation for damages of the land on account of digging and encroaching along with the interest from the

Patna High Court CWJC No.10489 of 2017(2) dt.21-04-2025 2/2 date of passing of the plan of the road to be constructed upon the petitioner's land, as upon the said land road has been constructed under the Prime Minister Rural Road Scheme without consent of the petitioner or for any other relief or reliefs to which the petitioner is found entitled in the facts and circumstances of the case."

3. Learned counsel for the petitioner submits that it will suffice if his case is heard and be disposed of by Respondent No. 4-the Divisional Commissioner, Munger.

4. The State has no objection to it.

5. In that background, the writ petition stands disposed of with a direction to the petitioner to approach to Respondent No. 4-the Divisional Commissioner, Munger in next four weeks. If such petition is filed, the same has to be taken up and disposed of at an earliest.
