====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 126(2), 115(2), 74, 351(2) and 351(3) of the Indian Penal Code and sections 8/12 of the POCSO Act.
3. As per FIR, petitioner is alleged to have teased and harassed daughter of informant, while she was going to the school.
4. Learned counsel appearing for the petitioner submits that petitioner is not the same as has been named in the FIR. Petitioner is 48 years old, while as per the FIR itself said accused is about 60 years old. Parentage of said accused person has not been mentioned in the FIR. Moreover, realising this mistake, informant and his daughter have filed a compromise petition in the court below denying the involvement of this petitioner in alleged occurrence. Petitioner claims clean antecedent.
5. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.7706 of 2025(3) dt.15-04-2025 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge VII cum Special Judge, POCSO, Patna in Gaurichak (Pachrukhiya) Police Station Case No. 422 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
