The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, while the petitioner and one Srikant Mandal caught hold of the informant, it is stated that Hiran Mandal fired on him injuring him.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. The petitioner is in custody since 25.4.2020 and his case stands on a similar footing to that of co-accused Srikant Mandal who has been enlarged on bail vide order dated 28.4.2021 passed in Cr. Misc. No. 6862 of 2021. Heard learned APP for the State.

No.17435 of 2021(4) dt.15-11-2021 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case together with grant of bail to co-accused Srikant Mandal, the petitioner is directed to be enlarged on bail in connection with Kahalgaon P.S. Case no.254 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge III - cum - Special Judge (SC/ST Act), Bhagalpur.
