The petitioners are apprehending arrest in connection with Madhuban P.S. Case No. 226 of 2019 for offences under Section 304(B), 201 and 34 IPC.
Considering the fact that the petitioner Nos. 1,4, and 5, namely, Hemanti Devi, Sakal Sahani and Ramlal Sahani are Pattidars, the Court is inclined to grant anticipatory bail to them. Let the petitioner Nos. 1, 4 and 5, namely, Hemanti Devi, Sakal
Patna High Court CR. MISC. No.5352 of 2020(4) dt.02-09-2020 2/2 Sahani and Ramlal Sahan, in the event of arrest or surrender within a period of one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five thousand) each with two sureties of the like amount each to the satisfaction of 4th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Madhuban P.S. Case No. 226 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
So far as the petitioner Nos. 2 and 3, namely, Ramsakhiya Devi and Indradeo Sahani are concerned, the court is not inclined to grant then anticipatory bail as they are parentsin-law. However, in the event the petitioner No. 2 and 3 namely, Ramsakhiya Devi and Indradeo Sahani, surrender before the Court below and prays for regular bail, the court below shall dispose of the application for regular bail on the same day on its own merit without being prejudiced by dismissal of their anticipatory bail application.
