The petitioner is in custody since 08.03.2016 in connection with a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is the elder brother-in-law of the deceased lady and was taken into custody on the basis of general and omnibus allegation levelled against all the family members. He further submits that the petitioner and his wife is living separately from the family and on the basis of the said finding during the course of investigation, the wife of the petitioner has been extended the privilege of anticipatory bail by this Court in Cr. Misc. No. 21859 of 2016 dated 23.05.2016.
Considering the aforementioned facts and circumstances and that the petitioner is elder brother-in-law and has been assigned
Patna High Court Cr.Misc. No.23382 of 2016 (2) dt.01-06-2016 P2/2 no definite role, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Nawada in connection with Narhat P.S. Case No. 158/2015.
