This application, for grant of anticipatory bail, arises out of Vaishali Police Station Case No. 281 of 2018, disclosing offences under Sections 341/323/353/384/379/427/504/34 of the Indian Penal Code.
The informant is Block Nazir of Vaishali block. It is alleged that the petitioner was demanding extortion from him at the rate of Rs. 10,000/- per month. It is also alleged that the petitioner and two other accused persons assaulted the informant when he was discharging his duties in the block. Learned Counsel appearing on behalf of the petitioner has submitted that he has been falsely implicated because he is
Patna High Court Cr.Misc. No.3702 of 2019(2) dt.25-01-2019 2/2 an R.T.I. activist and except for hot exchange of words between them, nothing had happened on the alleged date of occurrence. On perusal of the First Information Report, I am of the view that a case for grant of anticipatory bail is made out. Accordingly, this application is allowed.
Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, at Hajipur, in connection with Vaishali Police Station Case No. 281 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
