JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402 & 414 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

Two live cartridges are said to have been recovered from possession of petitioner No. 1 whereas; one live cartridge is said to have been recovered from possession of petitioner No. 2 while they along with others had assembled for committing dacoity, for which, petitioners are in jail custody since 13-012016. Both the above petitioners do not have any criminal

Patna High Court Cr.Misc. No.21093 of 2016 (2) dt.20-05-2016 2/2 antecedent, which is evident from paragraph-3 of the petition. Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Rajgir P.S. Case No. 09 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Bihar Sharif.
