The petitioners seek bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and under Sections 25(1-B) 26, 35 of the Arms Act. The petitioners were granted bail in the year 1993. The petitioners have misused the privilege of bail for about 22 years declared absconder and cause inordinate delay in disposal of the case. They are in jail since 31.03.2015 and 07.04.2015. The petitioners have already remained in jail for more than four months.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like

Upadhaya, the learned Additional Sessions Judge, IInd Munger in Sessions Trial No. 708A of 1997, arising out of Tarapur P.S. Case No. 74 of 1993, subject to the condition that one of the bailors of both the petitioners shall be close relative either brother or brother-in-law of the petitioners and having substantial immovable property and if the petitioners failed to appear in court on two consecutive dates without having plausible explanation, the court below shall cancel the bail bond of the petitioners.
