The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 364, 201 and 34 of the Indian Penal Code.

The informant happens to be own brother of the petitioner made allegation that his son was living with the petitioner and giving money to the petitioner after driving autorickshaw, but the petitioner and other accused persons killed his son.

It is submitted that during course of investigation, admittedly the informant is not an eye witness of the occurrence. The police after investigation, submitted charge sheet under

Patna High Court Cr.Misc. No.31056 of 2015 (3) dt.24-08-2015 2/2 Section 306 and 34 of the Indian Penal Code as the police found that the deceased himself committed suicide.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Rahui P.S.
