The petitioner seeks bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code. It is submitted that F.I.R. was lodged against un-known. During investigation the name of the petitioner has appeared in the confessional statement before the Police. Neither the petitioner has been put on Test Identification Parade nor any incriminating article has been recovered from his possession. He has been in custody since 15.04.2015 having no criminal antecedent. After investigation, charge-sheet has been submitted and there is no chance of tampering with the witnesses.

No.31681 of 2015 (2) dt.19-08-2015 2/2 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in Saharsa Sadar P.S. Case No. 202 of 2015 with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
