The petitioner seeks regular bail in connection with Excise case no. 328C2 of 2018 registered for the offence punishable under Section 30(a) of Bihar prohibition and Excise Act.
The allegation is regarding seizure of 401.4 ltrs. of illicit liquor from a Tata 407 vehicle and the petitioner was arrested from the vehicle.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and infact, he is neither the owner nor the driver of the said vehicle whereas the fact is that the petitioner had only taken a
Patna High Court Cr.Misc. No.3963 of 2019(2) dt.25-01-2019 2/2 lift in the said vehicle. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 27.11.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Addl. District & Sessions Judge-II, Jamui in connection with Excise case no. 328C2 of 2018.
