JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-02-2019 This is an application for grant of anticipatory bail in connection with Excise Case No. 141 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act.
Allegation as per F.I.R. is of recovery of 252 liters foreign liters from a Honda Amaze four wheeler and the petitioner is said to be the owner of said vehicle. Submission of learned counsel for the petitioner is that the liquor belongs to other accused person, who was arrested from the spot and the petitioner has falsely been implicated in this case. Further submitted that the petitioner is the owner of said vehicle and he has given his vehicle to one Anup Singh on rent and the petitioner has nothing to do with the
Patna High Court Cr.Misc. No.6232 of 2019(2) dt.04-02-2019 2/2 seized article.
Heard learned A.P.P. also.
Having heard both sides, considering the above facts and circumstances of the case and also considering the fact that the petitioner is owner of the said vehicle from which the recovery has made, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on its own merit, without being prejudice by order of this Court, if possible, to be disposed of on same day.
Accordingly, this application is dismissed.
