The petitioner seeks bail in a case under Section 380, 461 of the Indian Penal Code.

The petitioner is not named in the FIR. The name of petitioner figured in the case in the confessional statement of Dinesh Prasad and Ghuna Sah @ Dhuna Sah. From the house of the petitioner Rs. 55,000/- was recovered after the petitioner is said to have confessed his guilt.

It is submitted that after one year of the occurrence the search was made. The petitioner had kept the money for purchasing a motor cycle for giving to his son-in-law. Dinesh Prasad and Ghuna Sah @ Dhuna Sah have already been enlarged

Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah (West Champaran) in Bettiah Town P.S.
