The petitioners apprehend their arrest in connection with Mainatand P.S. Case No.97/2019 registered for the offence under Sections 341, 504, 354, 506/34 of the Indian Penal Code and under Section 7 of POCSO Act.

The allegation of outraging the modesty of the victim is against co-accused Jitendra Ram.

Learned counsel for the petitioner submits that so far as petitioners are concerned, there is no allegation of Section 354 of I.P.C or of Section 7 of POCSO Act. It is further submitted that co-accused Jitendra Ram has already married

Patna High Court CR. MISC. No.4161 of 2020(2) dt.03-03-2020 2/2 with victim. He further submits that the petitioner no.2 being mother, petitioner no.3, being brother and petitioner no.1 being family friend of the co-accused Jitendra Ram have been made accused in this case.

Considering the aforesaid facts and circumstances as well as nature of accusation, in the event his arrest/surrender within a period of six weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-1st-cum Special Judge, Bettiah, West Champaran, in connection with Mainatand P.S. Case No.97/2019, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
