The petitioner seeks regular bail in connection with Kadamkuan PS case no. 463 of 2018 registered for the offence punishable under Sections 401, 414 of Indian Penal Code.

The allegation is regarding the accused persons including the petitioner having been apprehended by the police when they were trying to flee away upon seeing the police and after they were arrested, on search, one iron rod was recovered from the co-accused person namely Sono and he disclosed that the stolen articles were kept at the house of Sumit Kumar. The police is said to have raided the house of Sumit Kumar and three LCD TV were recovered.

Patna High Court Cr.Misc. No.6238 of 2019(2) dt.04-02-2019 2/2 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having clean antecedent. It is further submitted that no recovery whatsoever has been made from the petitioner or from his house so as to implicate him in the alleged crime. It is further submitted that similarly situated co-accused has already been granted bail vide order dated 18.12.2018 passed in Cr.Misc. no. 75671 of 2018. Lastly it is submitted that the petitioner is languishing in custody since 10.08.2018.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge VII-cumACJM Civil Court, Patna connection with Kadamkuan PS case no. 463 of 2018.
